2. I agree to make my establishment available to bona fide members of the scheme who possess credits.
3. I commit to honoring all agreed bookings and will not cancel them, even if I receive paying requests for the same period before the arrival date. However, please note that Accommodation Swap does not guarantee acceptance of all booking requests. Members reserve the right to accept or refuse swaps based on their business needs.
4. Once a swap is accepted and confirmed, it constitutes a legally binding contract between the host and guest, and cannot be canceled unless mutually agreed upon.
The only exceptions are personal emergencies or legitimate booking mistakes by the host, in which case the host agrees to arrange and cover the cost of alternative accommodation for the guest.
If I violate clauses 1 to 4, the scheme administrators have the right to:
1 Cancel my membership without refunding any registration/subscription fees.
2 Revoke any accumulated credits or benefits without compensation.
5. Only the registered owner is authorized to make bookings and submit swap forms for friends or family. Correspondence regarding bookings must be initiated by the owner or an authorized manager, clearly stating their authority.
It is the owner's responsibility to ensure that any delegated manager is fully trained and understands the system. Additionally, the owner must confirm with Accommodation Swap that the delegated person is trained and authorized to handle bookings.
6. The registered person is solely responsible for the security of their reference number and absolves administrators of any liability if it is misused by third parties.
The registered person for both host and guest shall be held responsible and liable in the event of them, or there representative, using or forwarding an incorrect reference number for submission of swap forms.
7. The registered guest owner is liable for any damages or misconduct caused by sponsored friends or family.
8. If I (guest) cancel a booking within 7 days of arrival, I understand that I will lose the credits deducted for the swap. However, the host's normal trading terms may take precedence over this clause.
8.1 If I (guest) cancel a confirmed booking during peak holiday seasons, the host is not obligated to refund credits.
9. I agree to inform the scheme administrators of any changes to my circumstances, especially if I sell or transfer ownership of my establishment
10.If I cannot make my establishment available for swapping or if I resign from Accom Swap, my membership will be canceled, and any accumulated credits will be forfeited unless clause 12 applies.
11. If I specify a limited period for swaps on my listing, I will not request swaps with other members during the same period.
12. Accom Swap Credits Insurance Package - Defined:
Members who maintain up-to-date subscription payments, have been active members for a minimum of two years, and uphold good account standing are eligible for indefinite inclusion in the Accom Swap Credits Insurance Package. To retain this privilege, members must introduce at least one new member annually. Furthermore, they may nominate one beneficiary to inherit these benefits.
12.1 Transitioning Membership upon Sale or Closure:
Should members decide to sell or close their establishments, they may retain membership rights provided they have upheld membership for a minimum of two years, maintained a positive credit balance, and sustained current subscriptions. Additionally, they must commit to referring one new member annually to retain this option.
It's important to note that this arrangement is a privilege and may be subject to change or withdrawal at the discretion of management.
Please note that the provisions of items 12 and 12.1 do not apply in the event of resignation or default as outlined in items 1 to 4 above.
13. Credits have no cash value and are earned through swaping only. If I fail to renew my subscription or resign, I forfeit any owned credits.
14. Members are not allowed to sell or transfer credits to other members.
15. The initial 12 credits awarded on registration are for starting purposes only; additional credits are earned through hosting other members or purchasing "top-up" credits.
16. Subscription fees are due annually in May with a deadline of June 1st. A late penalty fee of 2% per month applies, and accounts may be suspended until payment is made.
16.1 Members are responsible for renewing fees in May, regardless of receiving renewal notices.
17. To become a member, I must:
17.1 Have an existing website or equivalent for members to view my establishment.
17.2 Run my establishment full-time according to hospitality standards.
17.3 Provide a high-quality service to fellow members.
17.4 Respond to email inquiries within 48 hours, unless there are mitigating circumstances.
17.5 Understand that Accommodation Swap operates on a cash-free basis except for additional services negotiated between host and guest such as breakfasts, dinners, trips, excursions etc.
17.6 Facebook web sites that are completely dedicated to the establishment (not part of an existing personal Facebook) are acceptable.
17.7 Web sites that can only be reached via searching within a dedicated server shall not be acceptable - a direct link into the web site is required.
18. Please note that the modus operandi of Accommodation Swap is based on a totally cash free stay except for breakfasts,other meals and other activities which can be negotiated between host and guest and paid for either by additional credits or cash.
19. By registering and joining Accommodation Swap Worldwide I thereby indemnify the company, its employees, agents and affiliates against any loss or damage, in whatever manner, howsoever caused and understand that utilization of the scheme and any swaps arranged is entirely at my own risk.
I further agree to absolve the administrators of any liability of whatsoever for the success, or otherwise, of this scheme and in particular with possible matters of dispute between guest and host vis a vis breakage's / security/ quality of establishment etc.
I understand that the same terms and conditions of occupancy shall apply to me when arranging a swap as would apply to normal paying guests.
20. I have read, accept and understand the content of the attached quality control policy(click here) document which forms part of this agreement.
21. The administrators of Accom Swap reserve the right to:
21.1 Add to, alter or amend any of the above and modus operandi as circumstances may prevail from time to time.
21.2 Cancel my membership without any form of compensation or refund of credits or membership fees should it be subsequently learned that false or fraudulent entries were made on the registration form or swap forms.
21.3 Cancel my membership without any form of compensation or refund of credits or membership fees should they receive three or more complaints from members of bad behaviour and or noncompliance with house rules.
21.4 The administrators reserve the right to terminate any membership due to:
1. abuse, swearing at, insulting of any of the Accommodation Swap staff
2. Bad mouthing or trying to bring in any disrepute or negativity or sewing seeds of discontentment within Accommodation Swap and towards any prospective new contacts or members.
3. A member deliberately attempting to coerce or convince another member into joining an alternative platform for swapping purposes
4. Noncompliance with any terms and conditions herein set out.
without any form of compensation, or refund of credits, or membership fees.
22. Intellectual property:
The Accommodation Swap Worldwide site and all original content is the sole property of Accommodation Swap and may not be duplicated or used in any way without prior written consent from the administrators.
23. Confidentiality:
Client records are regarded as confidential and therefore will not be divulged to any third party. Under no circumstances are registered members permitted to forward any other members e-mail address to third parties, or share their e-mail address to further their own agenda outside of Accommodation Swap internal usage and modus operandi.
24. By registering, I acknowledge to have read and understood all the above clauses and agree to accept and comply with the Terms and Conditions (Agreement and Code of Practice) outlined in this document.
