Accommodation Swap Membership Agreement

1. ACCEPTANCE:

By agreeing to this Agreement and Code of Practice, I acknowledge and accept the clauses herein. I have also read and understood the Terms and Conditions, Disclaimer, and Privacy Statement, accessible via the link at the bottom of this page, along with the "How it Works" and "Questions and Answers" pages related to website usage.

2. AVAILABILITY:

I agree to make my establishment available to bona fide members of the scheme who possess credits.

3. MEMBERSHIP REQUIREMENTS:

To become a member, I must:

  • Have an existing website or equivalent for members to view my establishment.
  • Provide a high-quality service to fellow members.
  • Respond to email inquiries within 48 hours, unless there are mitigating circumstances.
  • Understand that Accommodation Swap operates on a cash-free basis except for additional services negotiated between host and guest.
  • Facebook websites dedicated to the establishment are acceptable.
  • Websites that can only be reached via searching within a dedicated server are not acceptable—a direct link to the website is required.

4. BOOKING COMMITMENTS:

I agree to honor all confirmed bookings and will not cancel any agreed swap, even if I receive paid booking requests for the same period. However, members reserve the right to accept or refuse swaps based on their business needs.

5. CANCELLATION POLICY:

If I (guest) cancel a booking within 7 days of arrival, I understand that I will lose the credits deducted for the swap. The host's normal trading terms may take precedence, and during peak seasons, the host is not obligated to refund credits.

6. LEGALLY BINDING CONTRACTS:

Once a swap is confirmed, it becomes a legally binding agreement. Cancellations are only permitted by mutual agreement, personal emergencies, or genuine booking errors by the host. In such cases, the host must arrange and cover the cost of suitable alternative accommodation. Failure to do so may result in removal from the platform and forfeiture of all credits.

7. BOOKING AUTHORITY:

Only the registered owner or an authorized manager is authorized to make bookings. It is the owner's responsibility to ensure any delegated person is fully trained and authorized to handle bookings.

8. INITIAL CREDITS:

Initial credits are for starting purposes only. Additional credits are earned through:

  • Hosting other members.
  • Introducing a new member (5 free credits awarded PLUS R500 cash reward).
  • Applying to purchase "top-up" credits (subject to management approval).

9. CREDITS VALUE:

Credits have no cash value. If I fail to renew my subscription or resign, I forfeit any owned credits.

10. NON-TRANSFERABILITY:

Members are not allowed to sell or transfer credits to other members.

11. CASH-FREE STAYS:

Accommodation Swap operates on a cash-free basis except for meals and activities, which can be negotiated between host and guest.

12. CREDITS INSURANCE PACKAGE:

Members with up-to-date subscriptions for a minimum of two years and a good account standing are eligible for the Credits Insurance Package. Eligible members may nominate one beneficiary.

13. LOYALTY MEMBERSHIP:

To qualify as a Loyalty Member upon the sale or closure of their establishment, members must bring in one new member. As Loyalty Members, they may participate in the Accommodation Swap Credits Insurance Package, allowing them to retain membership and utilize their credits. Loyalty Members can remain part of the system until all their credits have been used. Once their credits are exhausted, they will be removed from the Accommodation Swap database unless they recruit one new member per year. Recruiting a new member grants them an additional year of membership, and this can be repeated annually. Members acknowledge that this arrangement is a privilege, subject to modification or withdrawal at the discretion of management.

14. SECURITY RESPONSIBILITY:

The registered person is solely responsible for the security of their reference number and absolves administrators of any liability if it is misused.

15. LIABILITY FOR GUESTS:

The registered guest owner is liable for any damages or misconduct caused by sponsored friends or family.

16. MEMBERSHIP CANCELLATION:

If I cannot make my establishment available for swapping or if I resign, my membership will be cancelled, and any accumulated credits will be forfeited.

17. LIMITED PERIOD SWAPS:

If I specify a limited period for swaps on my listing, I will not request swaps with other members during that same period.

18. SUBSCRIPTION FEES:

Subscription fees are due annually in May with a deadline of June 1st. A late penalty fee of 2% per month applies, and accounts may be suspended until payment is made. Members are responsible for renewing fees in May, regardless of receiving renewal notices. Should a member fail to renew his/her membership by paying the annual membership fee within 60 days from the invoice date, he/she will lose all remaining credits and there will be no refund of registration or subscription fees.

19. QUALITY CONTROL:

I have read, accept, and understand the attached quality control policy (click here), which forms part of this agreement.

20. ADMINISTRATORS' RIGHTS:

The administrators reserve the right to amend terms and to cancel membership without compensation for fraudulent activity, multiple complaints, or abuse of the platform and its staff.

21. INTELLECTUAL PROPERTY:

The Accommodation Swap site and all original content is the sole property of Accommodation Swap and may not be used without prior written consent.

22. CONFIDENTIALITY:

Client records are confidential and will not be divulged to any third party. Members may not share other members' contact details.

23. INDEMNITY:

By participating, I agree to indemnify Accommodation Swap from any loss or damage. Participation is undertaken entirely at my own risk, and I release the administrators from any liability related to swap requests or disputes.

24. CHANGE OF CIRCUMSTANCES:

I agree to inform the administrators of any changes to my circumstances, especially the sale or transfer of my establishment.

25. ACKNOWLEDGEMENT:

By registering, I acknowledge that I have read and understood all the above clauses and agree to comply with the Terms and Conditions outlined in this document.
