Accommodation Swap Membership Agreement and Code of Practice

1. ACCEPTANCE:

By agreeing to this Agreement and Code of Practice, I acknowledge and accept the clauses herein. I have also read and understood the Terms and Conditions, Disclaimer, and Privacy Statement, accessible via the link at the bottom of this page, along with the "How it Works" and "Questions and Answers" pages related to website usage.

2. AVAILABILITY:

I agree to make my establishment available to bona fide members of the scheme who possess credits.

3. MEMBERSHIP REQUIREMENTS:

To become a member, I must:

  • Have an existing website or equivalent for members to view my establishment.
  • Provide a high-quality service to fellow members.
  • Respond to email inquiries within 48 hours, unless there are mitigating circumstances.
  • Understand that Accommodation Swap operates on a cash-free basis except for additional services negotiated between host and guest such as breakfasts, dinners, trips, excursions, etc.
  • Facebook websites dedicated to the establishment (not part of a personal Facebook) are acceptable.
  • Websites that can only be reached via searching within a dedicated server are not acceptable—a direct link to the website is required.

4. BOOKING COMMITMENTS:

I commit to honoring all agreed bookings and will not cancel them, even if I receive paying requests for the same period before the arrival date. However, Accommodation Swap does not guarantee acceptance of all booking requests. Members reserve the right to accept or refuse swaps based on their business needs.

5. CANCELLATION POLICY:

If I (guest) cancel a booking within 7 days of arrival, I understand that I will lose the credits deducted for the swap. However, the host's normal trading terms may take precedence over this clause. During peak holiday seasons, the host is not obligated to refund credits.

6. LEGALLY BINDING CONTRACTS:

Once a swap is accepted and confirmed, it constitutes a legally binding contract between the host and guest and cannot be canceled unless mutually agreed upon. The only exceptions are personal emergencies or legitimate booking mistakes by the host, in which case the host agrees to arrange and cover the cost of alternative accommodation for the guest.

7. BOOKING AUTHORITY:

Only the registered owner is authorized to make bookings and submit swap forms for friends or family. Correspondence regarding bookings must be initiated by the owner or an authorized manager, clearly stating their authority. It is the owner's responsibility to ensure that any delegated manager is fully trained and understands the system. Additionally, the owner must confirm with Accommodation Swap that the delegated person is trained and authorized to handle bookings.

8. INITIAL CREDITS:

The initial 12 credits awarded on registration are for starting purposes only; additional credits are earned through:

  • hosting other members.
  • introducing a new member (5 free credits awarded).
  • Applying to purchase "top-up" credits.(to be approved by management).

9. CREDITS VALUE:

Credits have no cash value and are earned through swapping only. If I fail to renew my subscription or resign, I forfeit any owned credits.

10. NON-TRANSFERABILITY:

Members are not allowed to sell or transfer credits to other members.

11. CASH-FREE STAYS:

Accommodation Swap operates on a cash-free basis except for meals and activities, which can be negotiated between host and guest and paid for either by additional credits or cash.

12. CREDITS INSURANCE PACKAGE:

Members who maintain up-to-date subscription payments, have been active members for a minimum of two years, and uphold good account standing are eligible to participate in the Accommodation Swap Credits Insurance Package (refer to Clause 13). Eligible members may nominate one beneficiary to inherit these benefits.

13. TRANSITIONING MEMBERSHIP UPON SALE OR CLOSURE:

To qualify as a Loyalty Member upon the sale or closure of their establishment, members must bring in one new member. As Loyalty Members, they may participate in the Accommodation Swap Credits Insurance Package, allowing them to retain membership and utilize their credits.

Loyalty Members can remain part of the system until all their credits have been used. Once their credits are exhausted, they will be removed from the Accommodation Swap database unless they recruit one new member per year. Recruiting a new member grants them an additional year of membership, and this can be repeated annually.

Members acknowledge that this arrangement is a privilege, subject to modification or withdrawal at the discretion of management.

14. SECURITY RESPONSIBILITY:

The registered person is solely responsible for the security of their reference number and absolves administrators of any liability if it is misused by third parties. The registered person for both host and guest shall be held responsible and liable in the event of misuse or forwarding an incorrect reference number for submission of swap forms.

15. LIABILITY FOR GUESTS:

The registered guest owner is liable for any damages or misconduct caused by sponsored friends or family.

16. MEMBERSHIP CANCELLATION:

If I cannot make my establishment available for swapping or if I resign from Accom Swap, my membership will be cancelled, and any accumulated credits will be forfeited.

17. LIMITED PERIOD SWAPS:

If I specify a limited period for swaps on my listing, I will not request swaps with other members during the same period.

18. SUBSCRIPTION FEES:

Subscription fees are due annually in May with a deadline of June 1st. A late penalty fee of 2% per month applies, and accounts may be suspended until payment is made. Members are responsible for renewing fees in May, regardless of receiving renewal notices.

19. QUALITY CONTROL:

I have read, accept, and understand the attached quality control policy (click here) document, which forms part of this agreement.

20. ADMINISTRATORS' RIGHTS:

• The administrators may add to, alter, or amend any of the above and modus operandi as circumstances change.

• They may cancel my membership without compensation or refund if false or fraudulent entries were made on the registration or swap forms.

• They may cancel my membership without compensation or refund if three or more complaints of bad behaviour or noncompliance with house rules are received.

• Membership may be terminated for abuse, swearing at, or insulting Accommodation Swap staff; bad-mouthing or bringing disrepute to Accommodation Swap; attempting to coerce members into joining an alternative platform; or noncompliance with terms and conditions.

21. INTELLECTUAL PROPERTY:

The Accommodation Swap Worldwide site and all original content is the sole property of Accommodation Swap and may not be duplicated or used without prior written consent from the administrators.

22. CONFIDENTIALITY:

Client records are confidential and will not be divulged to any third party. Registered members are not permitted to forward other members' email addresses to third parties or share their email address outside of Accommodation Swap internal usage.

23. INDEMNITY:

By registering with and participating in Accommodation Swap Worldwide, I agree to indemnify the company, its employees, agents, and affiliates from any loss or damage, regardless of cause. I understand that participation in the program and any arrangements for swaps are undertaken entirely at my own risk. Furthermore, I release the administrators from any liability related to the success, acceptance, or rejection of swap requests, as well as any disputes that may arise between guests and hosts.

24. CHANGE OF CIRCUMSTANCES:

I agree to inform the scheme administrators of any changes to my circumstances, especially if I resign, sell, or transfer ownership of my establishment.

24. ACKNOWLEDGEMENT:

By registering, I acknowledge that I have read and understood all the above clauses and agree to accept and comply with the Terms and Conditions (Agreement and Code of Practice) outlined in this document.
